Ord. 617 RE: Cannabis

At last night's City Council meeting, the City Council voted 4-1 to introduce Ord. 617 as amended to allow cannabis-related businesses in some commercial districts in Brisbane.  These businesses include laboratory testing, warehousing, distribution, manufacturing, and delivery-only retail (walk-up retail establishments not allowed).  A Conditional Use Permit will be required for cannabis-related warehousing, distribution, manufacturing, and deliver-only retail, so the City can understand how the business works before a permit is issued.  Testing laboratories may require a Conditional Use Permit as well, depending on the districit they're located in within the city.

The Ordinance also establishes performance standards for the personal cultivation of medicinal and adult-use ("recreational") cannabis for personal consumption by eligible patients or adults 21 years or older on residential properties, consistent with State law requirements. No commercial cultivation of cannabis will be allowed in Brisbane.

The second reading of the ordinance is scheduled for the Council's September 7th meeting, with the ordinance taking effect in October (30 days after adoption). Businesses must wait until the ordinance is in effect to apply for a Conditional Use Permit.
